LPOS Website Terms of Use

Welcome to the Lowcountry Pearls of Service Foundation Inc. (“LPOS”), a South Carolina nonprofit corporation, website located at:
https://www.lowcountrypearlsofservice.com (the “Site”). The following terms and conditions (“Terms”) govern your access to and use of the Site.
By accessing, viewing, or using any content, materials, or services available on or through the Site, you acknowledge that you have read and understand these Terms and agree to be legally bound by them. If you do not agree to these Terms, or if you are under thirteen (13) years of age, you may not use the Site and should discontinue access immediately. Use of the Site by individuals under eighteen (18) years of age is permitted only with the involvement and consent of a parent or legal guardian. LPOS does not verify parental consent and disclaims responsibility for use of the Site by minors without such consent.
Informational Purposes Only
The information provided on the Site is for general informational purposes only. LPOS makes no representations or warranties regarding the accuracy, completeness, or timeliness of the information on the Site and is not responsible for any errors or omissions in the Site or Site Materials (as defined in Section 3 of these Terms).
2. Proprietary Rights
As between you and LPOS, LPOS owns or licenses all data, content, graphics, forms, artwork, images, photographs, functional components of the Site, software, documentation, and other materials on, in, or made available through the Site (collectively, the “Site Materials”), as well as the selection, coordination, arrangement, and organization of the Site Materials. All Site Materials are protected by copyright, trademark, patent, and other applicable laws.
You agree not to remove or alter any copyright notice or other proprietary notice appearing on any Site Materials. As between any user and LPOS, all names, trademarks, service marks, certification marks, symbols, slogans, or logos (collectively, “Intellectual Property”) appearing on the Site are proprietary to LPOS or to third parties that have licensed or authorized their use by LPOS. Any use of the Intellectual Property other than as expressly permitted by these Terms is prohibited and may violate federal or state law.
Except for the limited right to access and use the Site in accordance with these Terms, you acquire no ownership or other rights in or to any Site Materials or Intellectual Property.
3. Unauthorized Activities
You agree that you will not use the Site for:
(a) any illegal or unauthorized purpose, including any use that violates applicable local, state, national, or international laws or regulations;
(b) modifying, copying, distributing, displaying, performing, reproducing, publishing, licensing, creating derivative works from, transferring, or selling any Site Materials, except as expressly permitted by these Terms or authorized in a separate written agreement with LPOS;
(c) attempting to gain unauthorized access to LPOS’s computer systems, or engaging in any activity that interferes with, disrupts, or impairs the performance or functionality of the Site or any services made available through the Site; or
(d) removing, circumventing, disabling, damaging, or otherwise interfering with any security-related features of the Site that prevent or restrict unauthorized use of the Site or the Site Materials.
You may use the Site and the Site Materials only as permitted under Section 2 of these Terms. Any other use of the Site or the Site Materials without the prior written permission of LPOS is strictly prohibited.
You acknowledge that unauthorized use of the Site or the Site Materials may cause irreparable harm to LPOS, and that in the event of such unauthorized use, LPOS may be entitled to seek injunctive relief, in addition to any other remedies available at law or in equity.
4. User Submissions and Communications
a. User Submissions
LPOS may allow visitors to submit information through the Site, including through contact forms, newsletter sign-up forms, volunteer interest forms, event registrations, donation forms, or similar features (collectively, “User Submissions”). By submitting information through the Site, you affirm that:
(a) the information you provide is accurate, current, and complete to the best of your knowledge;
(b) you have the legal right to provide the information submitted; and
(c) your submission does not violate any applicable law or infringe upon the rights of any third party.
You agree not to submit any content or information that is unlawful, misleading, defamatory, harassing, abusive, obscene, or otherwise inappropriate, or that interferes with the operation or security of the Site.
b. Use of Submissions
User Submissions are provided voluntarily and may be used by LPOS solely for purposes consistent with its charitable and educational mission, including administering programs, responding to inquiries, coordinating volunteer activities, processing donations or registrations, and maintaining internal records. Submission of information does not obligate LPOS to respond to or act upon any User Submission.
User Submissions do not create a confidential, fiduciary, or contractual relationship between you and LPOS, except as required by applicable law or expressly stated in writing by LPOS.
c. No Public Posting
The Site does not permit public posting, commenting, or sharing of User Submissions. Information submitted through the Site is not displayed publicly.
d. Monitoring and Removal
LPOS reserves the right, but does not assume any obligation, to review, refuse, or remove any User Submissions that it determines, in its sole discretion, violate these Terms or are otherwise inappropriate.
5. Third Party Web Sites and Content
The Site may contain links to third-party websites for the convenience of users in locating information, products, or services that may be of interest. LPOS does not control and is not responsible for the content, accuracy, or availability of any third-party websites, or for the products or services offered by or advertised on such sites.
Your use of third-party websites is entirely at your own risk and subject to the terms and conditions of those websites. LPOS does not endorse, recommend, or assume any responsibility for any product, service, or information provided by or through any third-party website, nor for any transactions you may enter into with third parties.
6. Privacy Policy
Any personal information, including your name, email address, phone number, address, or other information (“Personal Information”), that you provide to LPOS through the Site is governed by LPOS’s Privacy Policy. For more information, please click here to view the Privacy Policy, which is incorporated into these Terms by reference, as if fully set forth herein.
While LPOS takes reasonable steps to protect Personal Information in accordance with its Privacy Policy, communications transmitted over the Internet may not be completely secure. Accordingly, LPOS cannot guarantee the absolute security of information transmitted through the Site or via electronic mail.
7. Disclaimer
LPOS does not guarantee the accuracy, completeness, or timeliness of any information or materials made available on or through the Site, including Site Materials and User Submissions. While LPOS may review, update, or remove Site Materials or User Submissions from time to time, LPOS has no obligation to do so and does not review all materials or communications submitted through or displayed on the Site.
LPOS reserves the right to modify or remove any Site Materials or User Submissions at any time, with or without notice, in its discretion. You are solely responsible for evaluating the accuracy, usefulness, and appropriateness of any information obtained through the Site, and you assume all risks associated with your use of the Site, the Site Materials, and any User Submissions.
THE SITE, THE SITE MATERIALS, AND ANY INFORMATION MADE AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND “WITH ALL FAULTS.” USE OF THE SITE IS ENTIRELY AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LPOS DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LPOS MAKES NO WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LPOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF DATA, LOSS OF USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE, THE SITE MATERIALS, OR ANY INFORMATION MADE AVAILABLE THROUGH THE SITE, REGARDLESS OF THE THEORY OF LIABILITY AND WHETHER OR NOT LPOS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL LPOS’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS EXCEED THE AMOUNT, IF ANY, PAID BY YOU TO LPOS FOR ACCESS TO OR USE OF THE SITE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
IF YOU ARE DISSATISFIED WITH THE SITE OR ANY PORTION OF THESE TERMS, YOUR PRIMARY REMEDY IS TO DISCONTINUE USE OF THE SITE.
9. Indemnification
You agree to indemnify and hold harmless LPOS and its directors and officers from and against any and all claims, actions, suits, proceedings, liabilities, damages, losses, costs, and expenses (including attorneys’ fees) arising out of or relating to: (a) your use of or access to the Site; (b) your violation of these Terms or any applicable law; or (c) any information or materials you submit through the Site, including any claim that such submissions infringe or violate the rights of any third party.
LPOS reserves the right, at its option, to assume the defense and control of any matter subject to indemnification by you, and you agree to cooperate fully in the defense of such claim.
10. Internet Security
LPOS uses reasonable efforts to ensure that the Site is generally available; however, access to the Site may be interrupted, suspended, or unavailable from time to time due to maintenance, technical issues, or circumstances beyond LPOS’s control. You agree that LPOS shall not be liable for any modification, suspension, or discontinuance of the Site.
You understand that the technical processing and transmission of information through the Site may involve transmissions over various networks not controlled by LPOS and may require changes to conform and adapt to technical requirements of connecting networks or devices. Communications over the Internet may not be completely secure. Accordingly, LPOS cannot guarantee the security or confidentiality of information transmitted through the Site or via electronic communications. The Site may be hosted and supported by third-party service providers, and LPOS is not responsible for the security practices of third parties.
11. Complaint Procedures
If you believe that any content made available on the Site infringes your intellectual property or other legal rights, please notify LPOS by email at lowcountrypearlsofservice@gmail.com. To be considered, your notice must include all of the following information:
(a) your name and contact information, including your email address;
(b) identification of the specific content on the Site that is the subject of the complaint, with sufficient detail to allow LPOS to locate it, and the specific rights you believe are being infringed;
(c) a detailed explanation of the nature of the rights you claim are being infringed and the basis for your complaint;
(d) reasonable documentation demonstrating your ownership of, or authorized right to enforce, the intellectual property at issue, such as registration information, publication details, or other evidence of ownership or authorization; and
(e) a statement that the information provided in your notice is true, accurate, and complete in all respects.
LPOS will review complaints that comply with this Section and may, in its sole discretion, request additional information or take such action as it deems appropriate. LPOS reserves the right to disregard or decline to act upon incomplete, unsupported, or bad-faith complaints.
12. Changes to these Terms; Termination
LPOS reserves the right, at any time, to modify, update, or revise these Terms. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of the Terms as modified and supersedes any prior version of the Terms with respect to your use of the Site.
Your permission to use the Site is conditioned on your compliance with these Terms. Any use of the Site in violation of these Terms is unauthorized. Continued use of the Site following any violation of these Terms constitutes a continuing violation of these Terms.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict-of-laws principles.
Any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located within the State of South Carolina, and you consent to the personal jurisdiction of such courts.
14. Miscellaneous
The Site is controlled and operated from within the United States. LPOS makes no representation that the Site, Site Materials, User Submissions, services, information, or other materials made available on or through the Site are appropriate or available for use in other locations, and access to them from territories where such access is illegal is prohibited. Those who choose to access the Site from other locations do so at their own initiative and are responsible for compliance with applicable laws.
The failure of LPOS to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision, nor shall any single or partial exercise of any right preclude any other or further exercise thereof or the exercise of any other right.
Headings used in these Terms are for convenience only and shall not affect the interpretation of these Terms. No person or entity that is not a party to these Terms shall be deemed to be a third-party beneficiary of any provision of these Terms. When used in these Terms, the words “include,” “includes,” and “including” shall be deemed to be followed by the words “without limitation.”
These Terms constitute the entire agreement between you and LPOS regarding your use of the Site and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, relating to the subject matter hereof.
